These Terms of Service ("Terms") govern your use of the Secondhand MCP service ("Service") operated by Sooks Labs LLC ("Company", "we", "us", "our"). By using the Service, you agree to be bound by these Terms.
Secondhand MCP provides an API that allows AI assistants (such as Claude and ChatGPT) to search secondhand marketplaces including Facebook Marketplace, Depop, Poshmark, and eBay. The Service acts as an intermediary, retrieving publicly available listing data from these third-party platforms on your behalf.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. You use the Service entirely at your own risk.
We make no guarantees regarding:
All listing data (prices, descriptions, availability, seller information) originates from third-party marketplaces and may be inaccurate, outdated, or incomplete. You should always verify listing details directly on the source marketplace before making any purchasing decisions.
The Service uses automated methods to retrieve publicly available listing data from third-party marketplaces at your request. These integrations may break, change, or become unavailable at any time without notice due to actions taken by the third-party platforms.
We do not have formal partnerships with or endorsements from Facebook Marketplace, Depop, Poshmark, or any other marketplace unless explicitly stated. The availability of each marketplace integration is not guaranteed.
By using the Service, you acknowledge and agree that:
The Company does not assume any obligations under the terms of service of any third-party marketplace. Any trademarks, brand names, or logos of third-party marketplaces referenced in the Service are the property of their respective owners and are used solely for identification purposes.
We target 95% monthly uptime for the Service. If the Service falls below 95% availability in any calendar month, you may request a prorated credit for that billing period by contacting us at support@secondhandmcp.com.
Uptime is measured as the availability of the core API endpoint. Downtime of individual marketplace integrations does not constitute a service outage, provided at least one marketplace connection remains operational.
Individual marketplace availability is not guaranteed. If a third-party marketplace changes its platform, blocks access, or becomes otherwise unavailable, you will continue to be billed for your subscription as long as the Service itself and at least one marketplace integration remain operational. We will make commercially reasonable efforts to maintain and restore marketplace integrations. If the number of available marketplaces is substantially reduced for an extended period, we may adjust pricing or offer affected users the option to downgrade or cancel.
The Service offers free and paid subscription tiers. Paid subscriptions are billed monthly through Stripe. By subscribing to a paid plan, you authorize recurring monthly charges to your payment method.
Usage limits reset on the first of each calendar month. Unused quota does not roll over.
You may cancel your subscription at any time through your account page or Stripe billing portal. Upon cancellation, you retain access to your paid tier through the end of your current billing period.
Refunds are available within 30 days of any charge by contacting support@secondhandmcp.com. After 30 days, charges are non-refundable. Refund requests related to uptime issues are subject to the 95% SLA described in Section 5.

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.
eBay integration requires you to provide your own eBay Developer API credentials. Your credentials are encrypted at rest using AES-256 and are only decrypted momentarily during request processing. We are not responsible for any actions taken on your eBay developer account as a result of using the Service.
The Service itself, including its source code, design, and documentation, is the intellectual property of Sooks Labs LLC. Marketplace data retrieved through the Service belongs to the respective third-party marketplaces and is provided for your personal, non-commercial informational use only.
You acknowledge that listing data, images, descriptions, and other content retrieved from third-party marketplaces are the property of those platforms and/or their users. The Service does not claim ownership of any third-party marketplace data.
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Sooks Labs LLC, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
This indemnification obligation does not apply to claims arising solely from the Company's gross negligence or willful misconduct.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, SOOKS LABS LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. We do not warrant that the results obtained from the use of the Service will be accurate or reliable.
To the maximum extent permitted by applicable law, Sooks Labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 3 months preceding the claim.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
You and Sooks Labs LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (collectively, "Disputes") will be resolved through binding individual arbitration rather than in court, except that either party may bring claims in small claims court if eligible.
Class Action Waiver: YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.
Arbitration Rules: Arbitration will be conducted by JAMS under its Streamlined Arbitration Rules and Procedures, or by another mutually agreed-upon arbitration provider. The arbitration will take place in Los Angeles County, California, or at another mutually agreed location. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Opt-Out: You may opt out of this arbitration provision by sending written notice to support@secondhandmcp.com within 30 days of first accepting these Terms. If you opt out, disputes will be resolved in the courts specified in Section 17.
Time Limitation: Any claim or dispute must be filed within one (1) year after the date the claim arose, or the claim is permanently barred. This limitation applies regardless of when you discovered or should have discovered the basis for the claim.
You must be at least 18 years old to use the Service. By using the Service, you represent that you are at least 18 years of age.
We may update these Terms from time to time. When we make material changes, we will notify you by email or by posting a notice on the Service. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. For any disputes not subject to arbitration, the exclusive venue shall be the state and federal courts located in Los Angeles County, California, and you consent to personal jurisdiction in those courts.
